Terms & Conditions

Welcome to balanceinc.ca. These Terms and Conditions (“Terms”) govern your access to and use of this website and your interactions with Balance Promotions Inc. (“Balance,” “we,” “our,” or “us”) through the website.

By using this website or submitting an inquiry through it, you agree to these Terms. Additional terms may apply to particular ticket transactions, event services, bookings, or other services provided by Balance.

Nothing in these Terms is intended to limit or exclude any right or remedy that cannot lawfully be limited or excluded under applicable law.

1. General Website Use

This website provides information about Balance Promotions Inc., our services, events, ticket inquiries, and related activities.

You agree to use this website only for lawful purposes and in a manner that does not interfere with its operation or the ability of others to use it.

You may not use the website to transmit unlawful, fraudulent, misleading, harmful, or unauthorized material or to attempt to gain unauthorized access to the website or related systems.

Balance may modify, suspend, restrict, or discontinue any portion of the website where reasonably necessary.

2. Intellectual Property

Unless otherwise indicated, content created by or for Balance on this website, including our name, logos, branding, text, graphics, designs, and original promotional materials, is owned by Balance or used with permission.

Certain photographs, event names, artist names, team names, venue names, trademarks, logos, and other materials may belong to their respective owners. Their appearance on this website does not necessarily indicate sponsorship, endorsement, affiliation, or ownership by Balance.

Website content may not be reproduced, distributed, modified, republished, or used for commercial purposes without applicable authorization or prior written permission from Balance.

3. Events, Bookings and Production Services

Information concerning events, artists, venues, schedules, availability, or services may be subject to change.

Submitting an inquiry regarding an event, artist, booking, production service, partnership, or other service does not by itself create a binding agreement.

Any applicable scope of services, pricing, payment requirements, cancellation terms, deliverables, and other material terms may be established separately in a written agreement, invoice, confirmation, or other transaction documentation.

4. Ticket Inquiries

Information displayed on this website concerning events or ticketing does not necessarily constitute an offer to sell a particular ticket.

Submitting a ticket inquiry does not constitute the purchase or reservation of a ticket.

Ticket availability, event details, seating or location information, pricing, applicable fees and other transaction terms will be confirmed as applicable before a ticket transaction is completed.

Ticket availability may change and remains subject to the applicable transaction terms and legal requirements.

5. Ticket Sales

Where Balance offers or sells tickets, the transaction is subject to applicable Ontario law, including applicable requirements under the Ticket Sales Act, 2017.

Where applicable, information concerning the ticket, seating or admission location, price, fees, taxes and other required information will be provided in connection with the ticket offer or transaction.

Tickets offered on the secondary market are subject to the protections, guarantees, confirmations, pricing requirements and other requirements prescribed by applicable law.

Nothing in these Terms limits any statutory ticket purchaser protection or refund entitlement.

6. Ticket Refunds and Cancellations

Except where a refund, credit, replacement, or other remedy is required by applicable law or expressly provided as part of a particular transaction, ticket sales are generally final.

Refund rights may depend on the circumstances of the particular transaction, including the reason for the refund request, the status of the event, the nature of the ticket, and applicable legal requirements.

Where applicable, statutory protections relating to cancelled events, ticket validity, counterfeit tickets, or tickets that do not correspond with their description will apply.

Customers seeking a refund should follow the refund request procedure provided on the Contact Us page and submit the requested transaction information and supporting documentation to:

refunds@balanceinc.ca

Submission of a refund request does not itself determine eligibility for a refund. Each request will be considered based on the circumstances of the transaction and applicable requirements.

7. Events, Venues and Admission

Events may be postponed, rescheduled, relocated, modified, or cancelled by event organizers, performers, leagues, venues, promoters, or other parties outside Balance’s control.

Admission remains subject to the rules, policies, security requirements, age restrictions, health and safety requirements, and other conditions imposed by the applicable venue, event organizer, primary ticket issuer, or other responsible party.

Balance does not control decisions made independently by venues, event organizers, performers, leagues, teams, or primary ticket issuers.

Any refund or other rights arising from such changes remain subject to applicable law and the terms governing the particular transaction.

8. Third-Party Services and Websites

Balance may interact with or provide links to third-party ticketing services, payment providers, venues, event organizers, social media services, or other external websites and platforms.

Third parties operate independently and may have their own terms, conditions, policies, and privacy practices.

Balance is not responsible for the independent operation, availability, content, security, or privacy practices of third-party websites or services.

Nothing on this website should be interpreted as representing that Balance is officially affiliated with, endorsed by, or authorized by a third party unless expressly stated.

9. Accuracy of Information

Balance makes reasonable efforts to provide accurate and current information.

Certain event, ticket, artist, venue, schedule, pricing, availability, and other information may originate from third parties and may change without notice.

Where there is a discrepancy between general information appearing on this website and the specific terms confirmed for a transaction, the applicable transaction documentation and any mandatory legal requirements will govern.

10. Limitation of Liability

To the extent permitted by applicable law, Balance will not be liable for indirect, incidental, special, or consequential damages arising solely from the use of, or inability to use, this website.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

The limitations contained in these Terms are subject to any mandatory consumer protection rights and remedies available under applicable law.

11. Prohibited Conduct

You may not use this website or Balance’s services to:

  • Engage in fraudulent or unlawful activity
  • Misrepresent your identity or transaction information
  • Interfere with the security or operation of the website
  • Attempt unauthorized access to systems or information
  • Use automated systems in a manner prohibited by applicable law
  • Infringe intellectual property or other legal rights
  • Submit knowingly false or misleading information

12. Privacy

Personal information collected through this website or through interactions with Balance is handled in accordance with our Privacy Policy and applicable Canadian privacy requirements.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Subject to any rights or procedures that cannot lawfully be restricted, disputes relating to these Terms will be determined in accordance with applicable Ontario and Canadian law.

14. Changes to These Terms

Balance may update these Terms periodically to reflect changes to our website, services, business practices, or applicable legal requirements.
